Cancellation Terms
These Cancellation Terms govern the cancellation of appraisal appointments and restoration service agreements with Heritage Home Care LLC. By scheduling an appraisal or entering into a restoration agreement with us, you agree to the terms outlined below.
1. Appraisal Appointment Cancellations
Online Appraisal Requests
Appraisal requests submitted through our website are preliminary inquiries and do not constitute a binding appointment. You may withdraw your request at any time before we confirm a scheduled assessment, at no cost. To withdraw a request, simply reply to the confirmation email you received or call us at +1 (617) 555-0143.
Scheduled In-Person Appraisals
Once an in-person appraisal appointment has been confirmed (you will receive a confirmation email with a date and time), the following cancellation terms apply:
- More than 48 hours before the appointment: You may cancel or reschedule at no charge. Please contact us by phone or email to arrange a new time.
- 24 to 48 hours before the appointment: We ask that you provide notice as a professional courtesy. No cancellation fee applies, but repeated same-day cancellations may result in a request for a nominal scheduling deposit for future appointments.
- Less than 24 hours before the appointment / No-show: While we do not charge a cancellation fee for first-time occurrences, we reserve the right to require a $75 refundable scheduling deposit for future appointments if a client has failed to appear for two or more confirmed appointments without prior notice.
2. Restoration Service Cancellations
Before Work Begins
If you have signed a restoration agreement but wish to cancel before any physical work has commenced on your item, you may do so in writing (email is acceptable) with no penalty. Any deposit paid will be refunded in full within 14 business days, minus any costs already incurred for specialty materials that were ordered specifically for your project and cannot be returned.
After Work Has Begun
Once restoration work has physically commenced, the following terms apply:
- You must submit your cancellation in writing (email to inquiries@heritagehomecare.info or a signed letter delivered to our workshop).
- Work will stop within 2 business days of receiving your written cancellation notice. Some in-progress procedures (such as a glue-up that is curing or a finish that has been partially applied) may need to be completed to a safe stopping point to avoid damage to the item.
- You will be invoiced for:
- All labor hours completed up to the stopping point, at the rate specified in your restoration agreement
- All materials purchased or consumed, including specialty woods, hardware, fabrics, and finishing products
- Return shipping costs, if applicable
- Refund of remaining deposit: Any prepaid deposit balance exceeding the costs described above will be refunded within 14 business days.
Items Left Unclaimed
If a restoration is canceled and the item is not retrieved or shipping is not arranged within 60 calendar days of the cancellation notice, Heritage Home Care LLC will send a written reminder to the client's address on file. If the item remains unclaimed for 120 calendar days, a daily storage fee of $5.00 will begin to accrue. Items unclaimed after 12 months may be subject to disposition in accordance with Massachusetts General Laws Chapter 200A (Abandoned Property).
3. Cancellation by Heritage Home Care
In rare circumstances, Heritage Home Care may cancel or decline to proceed with a restoration if:
- Upon detailed inspection, the item is found to contain hazardous materials (e.g., asbestos insulation, lead paint in a condition that cannot be safely managed) that pose a health risk to our artisans
- The item's condition deteriorates during transport in a way that fundamentally changes the scope of the proposed work
- The client requests modifications to the scope that conflict with our professional standards or conservation ethics
In any of these cases, we will notify you promptly, explain the reason in detail, and arrange for the safe return of your item at our expense. Any deposits paid will be refunded in full.
4. Force Majeure
Neither party shall be liable for delays or cancellations resulting from events beyond reasonable control, including but not limited to natural disasters, pandemics, government orders, or civil unrest. In such events, both parties will work in good faith to reschedule or adjust the scope of work.
5. Dispute Resolution
Any disputes arising from these Cancellation Terms shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached, disputes will be subject to mediation in Suffolk County, Massachusetts, before proceeding to binding arbitration under the rules of the American Arbitration Association.
