3. Liability Limitations
While Heritage Home Care LLC maintains comprehensive insurance coverage and follows best practices in the restoration industry, the following limitations apply:
- Maximum liability per item: Our total liability for any single item in our care shall not exceed $500,000 or the declared value of the item at the time of intake, whichever is less. Clients with items valued above $500,000 may arrange supplemental insurance at their own expense, and we will cooperate fully with their chosen insurer.
- Pre-existing conditions: Heritage Home Care LLC is not liable for damage or deterioration that existed prior to intake, as documented in the condition report prepared at the time the item is received.
- Consequential damages: Heritage Home Care LLC shall not be liable for indirect, incidental, or consequential damages (including loss of use, loss of profits, or loss of sentimental value) arising from any claim related to our services.
- Force majeure: Heritage Home Care LLC shall not be liable for loss or damage arising from events beyond our reasonable control, including natural disasters, acts of war, governmental actions, or widespread utility failures.
